These Terms of Service set out the basis on which Expert Nurse Witness Group provides nursing expert witness services. By contacting us, requesting a quotation, making a payment, or instructing us to provide services, you agree to these terms unless separate written terms are agreed.
1. About Our Service
Expert Nurse Witness Group provides independent nursing expert witness services for legal, professional and regulatory matters. We are not a referral agency or middleman. Instructions are reviewed and handled directly by appropriately qualified nursing professionals within the group.
2. Professional Status and Scope
All nursing experts within the group are registered with the Nursing and Midwifery Council and work within their professional scope of practice. We only accept instructions where the issues fall within appropriate nursing expertise. Acceptance of an enquiry does not automatically mean that an instruction has been accepted.
3. Enquiries and Instructions
Initial enquiries are reviewed to assess suitability, availability, conflicts of interest, scope of expertise, deadlines and documentation requirements. An instruction is only accepted once scope, fees, timescales and terms have been agreed in writing.
4. Information Required
You should provide a clear letter of instruction, a case summary, relevant records, documents, questions to be addressed, relevant deadlines, and any procedural requirements. We rely on the information provided by the instructing party and are not responsible for delays or limitations caused by incomplete, inaccurate or late documentation.
5. Fees, Quotations and Payment
Fees are based on the nature and complexity of the instruction, the volume of records, the urgency of the work, the expertise required and the work undertaken. A fee estimate or quotation will be provided where appropriate. Payment terms must be agreed before work begins. A deposit, staged payment, payment on account or payment in advance may be required. For fixed-fee reports, full payment may be required before work starts. For larger or complex matters, the balance may be payable before release of the final report unless otherwise agreed in writing.
6. Reports and Timescales
Timescales will be agreed according to expert availability, the nature of the report, the volume of documentation and the urgency of the matter. We will take reasonable steps to meet agreed deadlines, but timescales may change if additional records are provided, instructions change, or further clarification is required.
7. Duty to the Court and Independence
Our experts understand that their overriding duty is to the court. This duty is independent of the party instructing or paying the expert. Expert opinions are provided objectively, impartially and within the expert’s professional scope of practice.
8. Confidentiality and Data Protection
We treat case information, personal data and professional information confidentially. We do not publish individual expert profiles as standard. This approach supports professional privacy, personal data protection, data minimization and purpose limitation. Expert CV information may be provided on request where there is a clear professional purpose and suitability has been confirmed.
9. Cancellation, Postponement and Changes
If an instruction is cancelled, postponed or materially changed after work has started, fees may be payable for work already completed, time reserved, preparation undertaken, administrative time, meetings, record review, travel arrangements or other reasonable costs incurred. Where a deposit, payment on account or advance payment has been made, any refund will be considered by reference to the work completed, time reserved and costs already incurred at the point of cancellation. Expert availability reserved for court attendance, conferences, urgent work or fixed deadlines may attract cancellation charges if cancelled at short notice.
10. Limitation of Service
Our services are limited to professional nursing expert witness opinion and related medico-legal support. We do not provide legal advice, advocacy, treatment, case management, regulated financial advice or emergency clinical services through this website.
